HSE CAR 2012 Consultation: What the Four-Stage Clearance Independence Review Means for You

HSE consultation closed 9 January 2026 · source rechecked September 2026
HSE opened its consultation on 10 November 2025 and closed it on 9 January 2026. It proposed a regulatory change on independence and impartiality in four-stage clearance, plus guidance improvements for asbestos surveys and Notifiable Non-Licensed Work. The consultation did not itself change CAR 2012.

Why the Clearance Independence Question Matters

Four-stage clearance is the analyst-led handback process used for specified licensed asbestos enclosure work. HSG248 describes a preliminary site and work check, a thorough visual inspection, clearance air monitoring, and a final assessment after the enclosure is dismantled. The resulting Certificate for Reoccupation applies to the defined licensed work area and project.

HSE's regulatory proposal was to amend CAR 2012 and associated guidance so the roles in four-stage clearance are independent and impartial. Existing HSG248 analyst guidance already says analysts must ensure impartiality and independence for site clearance and certification, and strongly recommends that the building client independently sources and employs the analyst.

The current Experience Inputs Register does not approve a recurring first-party pattern about clearance certificates for this page, so this article does not use anecdotal project claims as evidence. The current position is grounded in HSE's consultation page and HSG248 rather than in an unverified case pattern.

What the HSE Consultation Covered

The consultation opened on 10 November 2025 and closed on 9 January 2026. HSE's official page sets out three proposal areas: independence and impartiality in four-stage clearance, improving asbestos-survey standards, and clarifying NNLW guidance. As checked on 14 September 2026, the page remains marked closed and says a summary of responses will be published there; no summary response is displayed on that page.

1

Independence and impartiality in four-stage clearance

Consultation proposal

The regulatory proposal was to amend CAR 2012 and associated guidance so that the roles in the four-stage clearance process are independent and impartial, reducing the risk of exposure after licensed asbestos removal.

2

Improving asbestos survey standards

A non-regulatory proposal sought to improve guidance and other interventions so dutyholders better understand the role of asbestos surveys and can commission a quality survey from a competent surveyor or organisation.

3

Clarifying NNLW

A non-regulatory proposal sought clearer guidance on the type of work that falls within Notifiable Non-Licensed Work, so dutyholders and contractors can apply the work categories more consistently.

What the Independence Requirement Means Right Now

The consultation did not itself amend CAR 2012. HSE's current analytical guidance already requires impartiality and independence for site-clearance certification, and HSE separately states that licensed-removal areas must be independently assessed by an analyst before reoccupation. The consultation proposed a clearer regulatory framework for the independence and impartiality of the roles involved.

If you are commissioning licensable asbestos work, use an HSE-licensed contractor and ask who will provide the analytical and clearance function where it is required. HSG248 strongly recommends that the building client independently sources and employs the analyst for site-clearance certification.

The UKAS Accreditation Standard

HSE states that analysts for asbestos-related work must be accredited by UKAS. Verify the named analytical organisation and the accreditation scope relevant to the work at ukas.com/find-an-organisation. This is a current provider check, not a claim that the 2025/26 consultation proposed UKAS accreditation for the first time.

Pro Asbestos Removal does not hold an HSE asbestos-removal licence and does not undertake licensable asbestos work directly. Where a project requires an HSE-licensed contractor or a separate analytical organisation, those external providers and their relevant credentials must be confirmed for that individual project; no standing laboratory or analyst partner is claimed here.

What This Means for Homeowners Commissioning Removal

Check who appoints the analytical organisation

For licensed work that needs four-stage clearance, HSG248 strongly recommends that the analyst for site-clearance certification is independently sourced and employed by the building owner, occupier or other building client in control of the premises.

Verify the named analyst or organisation

HSE states that asbestos analysts must be accredited by UKAS. Check the named organisation and the accreditation scope relevant to the analytical work rather than relying on a generic badge or a removal contractor's own credentials.

Use the project-specific handback

Where a licensed enclosure requires four-stage clearance, follow the analyst's project-specific Certificate for Reoccupation and handback instructions before treating that defined work area as released for normal use.

Treat the consultation as a proposal, not enacted law

The consultation closed on 9 January 2026. HSE states that responses will be analysed, proposals may be refined, and any legislative changes are subject to wider Government agreement and further communication before they come into force.

Check the Current HSE Position Before Relying on the Proposal

The consultation is closed, but its proposals are not presented here as enacted changes. For current licensable work, use the HSE-licensed-contractor route and verify any analytical organisation or UKAS scope required for the project.

Common Questions

What was the HSE CAR 2012 consultation about?

HSE opened the consultation on 10 November 2025 and closed it on 9 January 2026. It covered one regulatory proposal on independence and impartiality in four-stage clearance, plus non-regulatory proposals to improve asbestos-survey standards and clarify Notifiable Non-Licensed Work guidance.

What is the four-stage clearance procedure?

For licensed enclosure work where four-stage clearance applies, HSG248 describes a preliminary check of the site and work, a thorough visual inspection, clearance air monitoring, and a final assessment after the enclosure is dismantled. The competent analytical organisation records the project-specific handback and Certificate for Reoccupation.

What does HSE currently say about analyst independence?

HSG248 says the analyst must ensure impartiality and independence for site clearance and certification. It strongly recommends that the building owner, occupier or other building client independently sources and employs the analyst. Where shared links exist, HSG248 requires them to be addressed transparently with safeguards for impartiality.

Does HSE require UKAS accreditation for asbestos analysts?

Yes. HSE's asbestos guidance states that analysts for asbestos-related work must be accredited by UKAS. The consultation itself should not be described as proposing UKAS accreditation for the first time; it focused on independence and impartiality in four-stage clearance plus survey and NNLW guidance.

Does every domestic asbestos job need four-stage clearance?

No. Four-stage clearance is associated with specified licensed asbestos enclosure work, not every domestic asbestos job. The material, condition and task determine whether work is non-licensed, NNLW or licensable. Licensable work requires an HSE-licensed contractor and the project-specific licensed-work handback route.

Has HSE published the consultation response?

As checked on 14 September 2026, the official HSE consultation page is marked closed and says a summary of responses will be published on that page. No summary response is displayed on the official consultation page used for this update, so this article does not present the proposals as enacted regulatory changes.
